Terms of service

These terms govern the use of maslabs.it, of the MAS Labs account and of the products you find on the site, starting with Voxpert. By creating an account or using a product you accept them. They are written in plain language on purpose: if something is unclear, ask me first.

Who I am

The service is provided by Marco Andrea Sala (MAS Labs), Via N. Rusca 30/b, 23023 Chiesa in Valmalenco (SO) — VAT IT04007420161. For anything, write to [email protected].

The products

• Voxpert is your social media marketing expert: starting from what you tell it about your business it prepares posts, images, communication plans and the publishing calendar. When the feature is live, it will also be able to publish on the social channels you connect.
• Idea Audit: you send me an idea and I answer with a written audit. It is paid with the account's credits, at the price shown on its page.
• Custom software is governed by a separate quote and contract: these terms do not cover it.

The account

To use the products you need a MAS Labs account, tied to an email address you confirm with a code. You are responsible for what happens from your account: do not share your access codes and tell me straight away if you think someone else is using it.

The products are meant for people who run a business or a profession. You must be at least 18 to open an account.

Credits and payments

Voxpert and Idea Audit are pay-as-you-go, with the account's credits. The price list (how many credits each action costs) is shown in the Studio or on the product page before you start it. Credits are topped up by card through Stripe: Stripe handles the card details and they never reach me.

• Welcome credits are a gift: they have no cash value.
• Credits are deducted when you start an action; if the action fails, they come back to your account automatically.
• Purchased credits do not expire.
• You receive a payment receipt for every top-up; if you need an invoice, ask me.

What you create is yours

The texts, images and plans Voxpert prepares for you, and the materials you upload (photos, documents, price lists), remain yours. I only need permission to store and process them to run the service for you: you give it by using the product, and it ends when you delete the content or the account. I do not use them to advertise MAS Labs without asking you.

When you upload material you guarantee you have the right to do so: photos of recognisable people, trademarks and other people's texts are your responsibility.

Artificial intelligence

Voxpert's content is written by an artificial intelligence, guided by what it knows about your business. It can make mistakes: a price, an opening time, the wrong tone. Always read before you publish: what goes out on your channels, in your name, is your choice and your responsibility. I put the utmost care into the engine, but I cannot guarantee that every text is accurate or fit for every purpose.

Connected social channels

When publishing is live, you will be able to connect your channels to Voxpert (for example a Facebook Page, a professional Instagram account, a LinkedIn page). It works like this:

• you make the connection yourself, from the platform's official screen, and you see exactly which permissions you grant;
• Voxpert only publishes what you have approved or scheduled, and only on the channels you have connected;
• you can disconnect a channel at any time, from Voxpert or from the platform's settings (see the Data deletion page);
• by using these features you also accept the rules of the platform you connect. For YouTube in particular, the YouTube Terms of Service and the Google Privacy Policy apply.

Platforms can change their rules, or limit or suspend apps' access: in those cases some Voxpert features may stop working, and that is not up to me.

What you may not do

You may not use the products for content that is illegal, misleading, defamatory, that infringes other people's rights or the platforms' rules; to send spam; or to try to get around the limits, read other users' data or overload the service. If that happens I may suspend the account, after warning you where possible.

Availability and changes

I do my best to keep the service always on, but there may be interruptions for maintenance or because of suppliers' problems. A product may change, improve or, with reasonable notice, close: in that case purchased and unused credits are refunded.

Liability

I am liable for damage caused by my wilful misconduct or gross negligence. In other cases, and to the extent permitted by law, my liability towards those who use the products for their business is limited to what you paid in the previous twelve months. The rights the law grants to consumers always remain unaffected.

Closing the account

You can close the account whenever you want: the instructions are on the Data deletion page. I can also close it, with thirty days' notice, or immediately if you breach these terms.

Changes to these terms

If I change these terms I update the date at the top of the page and, if the changes affect you, I write to you before they take effect. If you do not agree you can close the account.

Law and jurisdiction

Italian law applies. For those who use the products for their business the competent court is Sondrio; for consumers, the court of the place where they live.
